These terms govern your use of forgeit.agency, the website operated by Sim Tec MD Inc. under its registered trade name Forge Marketing Platform, from 223048 Township Rd 84, Lethbridge County, Alberta, Canada. In this document “we” and “us” mean that company, and “you” means anyone using the site. By using the site you accept these terms; if you do not accept them, please do not use it.
Two things these terms are not, because the distinction matters:
- They do not govern work we perform for a client. Services are governed by the written proposal, order, or agreement you sign with us, which prevails over anything on this website if the two ever disagree.
- They do not govern the Forge platform application at app.forgeit.agency, which has its own Terms of Service and Privacy Policy.
1. What is on this site
The pages here describe our services, our approach, and our pricing in general terms. They are provided for information, and they are an invitation to talk rather than a binding offer. Nothing on this site creates a contract between us. A contract exists only once we both sign a proposal or order.
We keep the site accurate and current as best we can, but descriptions, packages, and prices change. The figures that bind us are the ones in your signed document, not the ones on a web page you saw earlier.
2. No guarantee of results
We sell marketing services. Marketing outcomes depend on your market, your offer, your pricing, your capacity to answer the phone, your competitors, and the advertising platforms themselves — most of which are outside our control and none of which we can promise.
Nothing on this site is a guarantee, warranty, or prediction of any particular result, revenue, lead volume, ranking, or return on advertising spend. Case studies, testimonials, and example figures describe what specific clients experienced. They are not a promise of what you will experience.
Nothing here is legal, accounting, tax, or professional advice. Decisions about your business remain yours.
3. Enquiries, forms, and bookings
When you submit a form or book a consultation on this site, you confirm that:
- the details you give us are accurate, and the contact details are yours to give;
- you are authorised to make the enquiry on behalf of the business you name, if you name one;
- you are asking us to respond, and you consent to us contacting you about that enquiry by email, telephone, and text message at the details you provided.
You can withdraw that consent at any time by telling us to stop, by using the unsubscribe link in any marketing email, or by emailing info@forgeit.agency. What we do with your information is set out in our Privacy Policy.
Booking a consultation costs nothing and commits you to nothing. We may need to reschedule occasionally, and we will give you as much notice as we can.
4. Acceptable use
You agree not to:
- use the site for any unlawful purpose, or in breach of anyone else’s rights;
- submit false, misleading, or automated enquiries, or use our forms to send unsolicited material;
- scrape, harvest, or systematically copy the site or the contact details on it, whether by hand or with automated tools;
- attempt to gain unauthorised access to the site or any connected system, probe it for vulnerabilities without our written permission, or interfere with its operation;
- copy the site’s design, copy, or code to build a competing offering, or frame or mirror it as your own.
We may block access to anyone who does these things, without notice.
5. Intellectual property
The site and everything in it — the text, design, layout, graphics, photographs, and underlying code — belongs to Sim Tec MD Inc. or to the people who licensed it to us, and is protected by copyright and other laws. The names Forge It Agency and Forge Marketing Platform, and our logo, are ours.
You may view the site, and print or share individual pages for your own business evaluation. Anything beyond that — republishing, redistributing, or commercial use — needs our written permission. Client names and logos shown on the site belong to those clients.
6. Pages we operate for clients
Some pages served under this domain are marketing pages we build and run on behalf of our clients, carrying that client’s branding, offer, and prices. The client is responsible for the offer described on such a page and for the goods or services it promises. Any enquiry you submit there is collected for that client, as explained in our Privacy Policy.
7. Links to other sites
The site links to services and websites we do not operate. We include those links for convenience. We do not control what is on them, we do not endorse them by linking, and we are not responsible for them. Their terms and privacy policies apply when you go there.
8. Availability
We aim to keep the site available, but we do not promise it will be uninterrupted or error-free. We may change, suspend, or withdraw any part of it, at any time, without notice.
9. Disclaimer
The site and its content are provided “as is” and “as available”, without warranties of any kind, express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent the law allows.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of your use of this site. Our total liability arising out of or relating to this site and these terms will not exceed one hundred Canadian dollars (CAD $100).
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud. This clause governs the website only; liability under a services agreement is dealt with in that agreement.
11. Indemnity
You agree to indemnify us against claims, damages, and reasonable costs arising from your use of the site in breach of these terms, or from your violation of the law or of anyone else’s rights.
12. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of Alberta have exclusive jurisdiction, subject to any rights you have under consumer-protection law that cannot be waived.
13. General
- If any provision of these terms is found unenforceable, the rest continues to apply.
- Our not enforcing a provision on one occasion does not waive our right to enforce it later.
- These terms, together with the Privacy Policy, are the whole agreement between us about your use of this website.
14. Changes to these terms
We may update these terms. The date at the top always reflects the current version. Continuing to use the site after a change means the updated terms apply to you.
